S. 3618 would require the Federal Trade Commission, in coordination with the Food and Drug Administration and the Drug Enforcement Administration, to report on the ability of minors to access fentanyl through social media platforms within one year of enactment. The report would need to address the prevalence of fentanyl access by minors on social media, the methods used by drug sellers to market and distribute fentanyl through social media platforms, and the effectiveness of existing platform policies and law enforcement measures in addressing fentanyl access by minors.
Using information on the costs of similar reports, CBO estimates that implementing the bill would cost less than $500,000 over the 2026-2031 period. Any related spending would be subject to the availability of appropriated funds.
