S. 2807 would expand the authority of the Department of Veterans Affairs (VA) and the Department of the Army to disinter the remains of or remove a memorial to a person from a national cemetery if the person is found to have committed a capital crime or certain sex-related crimes. Under current law, that authority exists for interments or memorializations that have occurred after December 20, 2013; the bill would extend that authority to cover interments or memorializations that have occurred on or after June 18, 1973.
VA testified that it is aware of seven decedents in VA national cemeteries who could be subject to disinterment under S. 2807. Because few disinterments and memorial removals would be likely to occur, CBO estimates that implementing S. 2807 would cost less than $500,000 over the 2026-2031 period. Any related spending would be subject to the availability of appropriations.
